1. Eligibility
Eligible winners (16 years old or older) must operate businesses in the Atlanta Metropolitan area. Employees, as well as subsidiaries, affiliates, suppliers, advertising, and employees’ immediate family members are ineligible to participate in the contest.
2. Agreement to Rules
Businesses that enter the contest agree to abide by Frenik’s Official Rules and decisions. We reserve the right to refuse, withdraw or disqualify entries at our sole discretion. Participants agree to accept the decisions of Frenik as final and binding.
3. Entry Period
The contest period will range from June 29 at 9 a.m. (ET) through July 13 at 5 p.m. (ET). Entries will only be accepted during these dates and times.
4. How to Enter
Accepted methods for entering the contest including posting on Facebook and Instagram business profiles about the following information: Like our contest post on Facebook & Instagram; explain how your business or another business stayed connected to or supported employees, friends, neighbors or strangers during trying times. Include video (60 seconds max), photos, graphics or other visuals that illustrate your company’s story; tag Frenik on Facebook and Instagram; use the hashtag #TransformATL. And tell us what marketing services your business needs right now. Fraudulent methods of entry or circumvention of the rules may result in the invalidation of participant entries.
5. Prizes
Two grand prize winners will receive approximately $10,000 of marketing services from Frenik Marketing Group. The type of marketing services available include SEO, branding and copywriting. Prices are not transferable. Acceptance of prizes grants Frenik permission to use grand prize winners’ entries, names, and likeness for advertising, promotion and trade without further compensation or remuneration unless prohibited by law. Prizes worth more than $600 in the United States may include a 1099 for tax purposes.
6. Selection and Notification of the Winner
Winners will be selected by a panel of judges under Frenik’s supervision. Participants will be notified July 14, 2020 in a live event and via email. Winners must claim prizes within 24 hours or may forfeit the prizes. Frenik is not responsible for liable for winners’ failure to receive notification of winning if he or she provided an incorrect email address or phone number, or if email security settings caused contest notifications to go to spam or junk folders.
7. Rights Granted by the Entrant
Submission of an entry into the contest grants Frenik the right to use the participant’s submission, voice, likeness, image and statements about the contest, etc., for publicity, news, advertising, promotional purposes, trade and so forth, without any further notice, review, consent, compensation or remuneration. Entries must be original work and not violate any proprietary or intellectual property rights. Consequences for entries that infringe upon the intellectual property rights of others may include disqualification. Claims that arise as a result of infringement shall be defended or settle at participant’s sole expense, and Frenik shall be held harmless from any suit, etc.
8. Terms & Conditions
Frenik reserves the right to modify, suspend, cancel or terminate in the event that non-authorized human intervention, a bug or virus, fraud or other causes beyond our control impacts or corrupts the security, fairness, proper conduct, or administration of the contest. We reserve the right to disqualify anyone who violates the terms, as well as seek damages to the fullest extent permitted by law in cases where a participant has caused deliberate damage or undermined the legal operation of the promotion.
9. Limitation of Liability
Participant’s entry into the contest constitutes his or her agreement to release and hold harmless Frenik and its subsidiaries, affiliates, employees, etc., against all claims liability, illness, injury, death, loss, etc., that occurs directly or indirectly from participation in the contest or use/misuse of the awarded prize.
10. Disputes
The entrant agrees, as a condition of participating in the promotion, that disputes not resolved between the participant and Frenik shall be individually resolved exclusively before a court located in Georgia, without resorting to any form of class action. Entrants waive all rights to punitive, incidental or consequential damages, and entrants waive all rights to have damages multiplied or increased.
